I've been in an accident involving a large truck: what should I do?
First, make sure that any injured individuals are receiving medical attention and notify law enforcement. Then, write down the insurance information, names, addresses, and phone numbers of everyone involved, including drivers, passengers, pedestrians, cyclists, etc and any witnesses. If you have a camera, take pictures of the accident. Contact your insurance company as soon as you are able, because any delays might hurt your case.
Attorneys for the trucking company were at the scene very fast and asking me lots of questions, what should I do?
Don't answer any questions, and certainly don't sign anything! Trucking companies commonly send their representatives to the scene, hoping to take advantage of victims who are dazed and disoriented by the accident. They want you to sign away your rights or make self-incriminating statements. Politely refuse to talk to any attorney or agent representing anyone but yourself, and contact an attorney who can speak for you as soon as possible.
Oops! I made a statement and signed an accident report for the trucking company. Does that mean I don't have a case?
No. You may have damaged your case, but many judges and experienced attorneys can see through these tactics practiced by trucking companies. Only an experienced lawyer can tell you what options you have. If you did sign any forms or affidavits, make sure you have copies and get in touch with a lawyer right away.
Should I go to the doctor after an accident, even if I don't feel any pain?
Yes. Some injuries, especially brain and/or spinal injuries, may not cause any immediate pain. You may also not feel any pain because of the effects of shock from the accident. A visit to your doctor will not only detect concealed injuries, but it also establishes a medical record in case one is needed for your case.
I don't think I can afford an attorney. What should I do?
Contact an attorney that offers a free initial consultation. Also, make sure you work with a lawyer who charges on a contingency basis. That way, they don't get paid unless you do, and your out-of-pocket expenses for the trial will be minimal or none.
